Restrictive driver's licenses are issued at the discretion of the California Department of Motor Vehicles. Given the discretionary nature of restrictive driver's license, it is helpful to have the assistance of an attorney with significant experience handling issues related to the suspension, revocation, and reinstatement of driving privileges. Three things are required at the time the application for a restrictive driver's license is filed:
Unfortunately, it is not possible to apply for a restrictive driver's license at the administrative license suspension hearing. For first-time DUI offenses there is a thirty day mandatory suspension after which you can apply for a restrictive driver's license. For second and multiple DUI offenses within a ten year period the mandatory suspension is increased to one year. In addition, an ignition interlock device is an additional restriction that may be placed on you prior to receiving a restrictive driver's license.
