Once you are arrested for driving under the influence, the arresting officer is required to confiscate your driver's license and issue a notice of suspension or revocation. It is vital to request a hearing within ten days of receiving the notice of suspension. Failure to request an Administrative License Hearings will result in an automatic driver's license suspension.

The length of a driver's license suspension varies. For a first offense, a license is suspended for four months. Every offense after the first in a ten year period will result in a one year suspension. California's Zero Tolerance Policy requires a one year driver's license suspension for drivers under the age of twenty-one with a blood alcohol level of .01 or higher.

Restrictive Driver's Licenses

California DMV license suspension does not necessarily mean that you cannot drive to and from work.
